Terms of Service

By subscribing to a my99agency plan, you agree to these Terms. Read carefully.
1. What we offer
my99agency is a subscription marketing service. We deliver creative pieces (flyers, posts, reels, videos, ads, websites) in the quantity defined by the plan you contracted. We're not strategic consulting nor a traditional agency; we're a production team connected to you through a platform.
2. Subscription and payment
- Monthly recurring billing via PayPal in USD.
- No long-term commitment. Cancel anytime from the portal — takes effect at the end of the current cycle.
- No retroactive refund. You use the service through the end of the cycle you paid for.
- Payment failure: we retry twice over 7 days; if it keeps failing, the subscription is suspended and requests pause until resolved.
3. Monthly quotas
Each plan defines how many pieces of each type you can request per cycle (30 days). Quotas don't roll over. See your current quota in the portal.
4. Content ownership
- Approved final files are yours, with full commercial use rights assigned.
- my99agency keeps the right to display work in portfolio and marketing materials, unless you request confidentiality in writing.
- Source files (.psd, .ae, .prproj) stay with my99agency; you receive rendered finals.
5. Revisions
Each piece includes up to 2 revision rounds. Additional revisions may use quota of another equivalent piece by arrangement.
6. What we don't do
- No illegal, offensive, fake-news content, or content violating third-party rights.
- No unlicensed imagery.
- No out-of-scope services (programming, BI, legal, accounting).
7. Termination by us
We can terminate your account for: payment fraud, abusive use, illegal content requests, or inactivity over 6 months. We refund pro-rata of the current cycle.
8. Limitation of liability
Our total liability is limited to fees paid in the last 3 months. We're not liable for lost profits, indirect damages, or commercial impact from the content (campaign performance, sales results, etc).
9. Governing law
These terms are governed by the laws of the State of Florida, USA. Disputes will be resolved in Miami-Dade County courts.
